Time extended till June to pay stamp duty dues

MUMBAI: A notification extending the Stamp Duty Amnesty Scheme 2023 till June 30 of this year has been released by the Maharashtra Government. It was required because the scheme’s term ended on March 31.

“Whereas, the Government of Maharashtra considers it expedient to amend the said order so as to extend the period of the second phase from March 1 till June 30, 2024, for the said Amnesty Scheme-2023,” the notification said.

The documents that have not been paid in full will be certified by the department as having been paid under the Stamp Duty Amnesty Scheme. The programme requires the beneficiaries to apply both offline and online.

Depending on when the documents were executed and when the beneficiary filed their application to be eligible for the scheme’s benefits, the department will collect the applicable stamp duty on the date of execution of the documents by providing relief from the stamp duty amount and penalty.

A penalty of two per cent per month or part up to 400 per cent penalties are levied on stamp duty dues. The waiver is granted based on the date of application, the date of agreement, and the stamp duty due.

The Amnesty Scheme covers all instruments relating to the transfer of immovable property under the Maharashtra Stamp Act, 1958, whether registered or not, residential, non-residential, industrial, agricultural, or non-agriculture.

Schedule I includes instruments signed between January 1, 1980 and December 31, 2000, and Schedule II dates from January 1, 2001 to December 31, 2020.

Previously, in response to low revenue mobilisation, the state government had extended the Stamp Duty Amnesty Scheme’s term until March 31, this year.
