NEW DELHI: The Supreme Court on March 21 dismissed application seeking a stay on the new procedure for appointing newElection Commissioners. It also asked the Centre to file a response within six weeks on the petitions that challenged constitutional validity of the Chief Election Commissioner and Other Election Commissioners Act, 2023.
Petitioners had challenged the validity and sought a stay on the operation of Section 7 of the Chief Election Commissioner and Other Election Commissioners Act, 2023 which excludes the Chief Justice of India from the panel that picks the Chief Election Commissioners and Election Commissioners.
Dismissing the plea, the apex court said that a stay on new legislation on appointment of ECs will create chaos, uncertainty as Lok Sabha elections are round the corner.
