SC judge stresses Indo-US judicial collaboration

Justice Hima Kohli, Judge of the Supreme Court, has emphasised the pivotal role of the IndiaUS partnership, particularly in judicial collaboration and the shared commitment to the rule of law at the American Bar Association’s India Conference 2024 that took place on March 28 and 29 in New Delhi.

Speaking on the theme, “Role of the Judiciary and the Rule of Law in Advancing Economic Development,” Justice Kohli underscored the importance of legal systems and judicial actions in supporting economic growth, security, and innovation.

“The partnership between India and the USA, particularly through judicial collaboration and mutual respect for the rule of law, offers a tremendous opportunity to enhance economic development. By focusing on areas such as providing certainty in law, quick resolution of disputes, protection of property rights, enforcement of contractual obligations, and digital transformation, both countries can create a more favourable environment for economic growth and innovation,” said Justice Kohli.

She emphasised that learning from the US experience and fostering closer judicial and legal cooperation will not only benefit economic ties but also strengthen the democratic and legal systems’ foundation in India.

According to Justice Kohli, the American-Indian relationship epitomises mutual respect for the rule of law and democratic principles, essential for promoting economic development and innovation within their respective borders.

She highlighted the potential of judicial cooperation between the two prominent democracies to stimulate economic progress by providing a consistent and predictable environment for enterprises and investors.

Justice Kohli noted the judiciary’s nuanced understanding of balancing civil liberties and fostering economic progress through interpretations and rulings over the years. She highlighted the US judiciary’s approach to dispute resolution, which considers broader economic implications, including the impact on investment climate, market stability, and overall economic well-being.

“In striking this balance, courts have often navigated complex scenarios where economic policies and individual rights have intersected,” she added.
