NEW DELHI: A five-judge Constitution Bench of the Supreme Court has unanimously refused to accord legal recognition to samesex marriage under the Special Marriage Act, ruling that it is within Parliament’s ambit to change the law for validating such union.
By a 3-2 majority, the court on October 17 also declined to grant constitutional protection to civil unions and adoption rights for queer couples, noting that mandating the State to grant recognition or legal status to some unions will violate the doctrine of separation of powers and could lead to unforeseeable consequences.
